User Agreement

This User Agreement (“Agreement”) is a binding contract between PLAYIT TECHNOLOGY PTE. LTD. (“we,” “our,” or “us”), the developer of PlayShort, and you, the user (“you” or “user”). By accessing and using PlayShort, you agree to comply with and be bound by this Agreement. Please read it carefully before using PlayShort.

If you do not agree to the terms and conditions outlined in this Agreement, you must not use PlayShort.

1. Introduction

This Agreement governs your use of PlayShort, which provides access to licensed short drama content. PlayShort is available for download and use on mobile devices, and by using PlayShort, you agree to the terms and conditions set forth herein.

2. Account Registration

To use PlayShort, you must create an account by logging in through your Google account. The information required for registration may include, but is not limited to, your name, email address, and profile picture. By registering and using PlayShort, you represent and warrant that the information you provide is accurate, complete, and up-to-date.

2.1 Google Account Login

To facilitate a seamless and secure login experience, we use Google authentication. By logging in with your Google account, you grant us permission to access basic information from your Google profile, such as your name and email address. Your password is securely managed by Google and is not stored or accessible by us.

You are solely responsible for maintaining the confidentiality of your Google account credentials. We will not be liable for any unauthorized access to your account.

2.2 Account Security

You agree to notify us immediately of any unauthorized use of your account or any other security breaches. We are not responsible for any loss or damage arising from your failure to protect your account.

3. User Conduct

By using PlayShort, you agree to comply with the following conduct rules:

Non-UGC Platform: PlayShort does not allow User-Generated Content (UGC). All short drama resources available on PlayShort are purchased through legal licensing agreements. You are prohibited from uploading, sharing, or distributing any content on PlayShort that violates copyright laws.

Prohibited Activities: You agree not to use PlayShort for any illegal, harmful, or disruptive activities, including but not limited to:

• Violating any applicable laws or regulations.
• Uploading or distributing malware, viruses, or other harmful content.
• Engaging in fraudulent activities or promoting fraud.
• Infringing on the intellectual property rights of others.

Any violation of these terms may result in the suspension or termination of your account and access to PlayShort.

4. License to Use PlayShort

Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use PlayShort solely for personal, non-commercial purposes. This license does not grant you any ownership rights in PlayShort or any content accessed through PlayShort.

5. Content

All content available on PlayShort, including but not limited to short dramas, episodes, and videos, is licensed from third-party content providers and is protected by copyright, trademark, and other intellectual property laws. You may only access and use the content for personal, non-commercial purposes within PlayShort. You agree not to download, redistribute, modify, or otherwise use the content for any purpose other than personal enjoyment.

We do not allow any User-Generated Content (UGC) on PlayShort. All content on the platform is purchased by us under licensing agreements, and we hold the necessary rights to provide this content to you.

6. Payment Terms

Access to the Platform, or to certain features of the Service, may require you to pay fees. Before you pay any fees, you will have an opportunity to review and accept the fees that you will be charged. All fees are non-refundable.

PlayShort will charge the payment method you specify at the time of purchase. You authorize PlayShort to charge to that payment method all sums for orders that you make and any level of Service you select as described in these Terms or published by us. If you pay any fees with a credit card, PlayShort may seek pre-authorization of your credit card account prior to your purchase to verify that the credit card is valid and has the necessary funds or credit available to cover your purchase. Payment processing services are provided by the third-party service through which the purchase is made (e.g., Apple In-App Purchases, Google Play).

All purchases may be subject to taxes and other fees, including, without limitation, foreign exchange fees or differences in prices based on location (e.g. exchange rates). We may calculate taxes payable by you based on the information that you provide us via your Account or at the time or purchase.

7. Data Collection and Privacy

We are committed to protecting your personal data. Our Privacy Policy outlines the types of data we collect, how we use it, and how we protect it. By using PlayShort, you consent to the collection and processing of your data in accordance with our Privacy Policy.

We collect the following types of data:

• Personal Information: Collected when you log in via your Google account (e.g., name, email address).
• Device Information: Includes device model, operating system, unique identifiers, and other technical data.
• Usage Data: Tracks your interactions with PlayShort, such as pages visited and actions taken.
• Location Data: If you grant permission, we may collect location data to offer personalized content.

We may share your data with third-party service providers, such as analytics services and advertising networks, as outlined in our Privacy Policy. These third parties are required to comply with strict data protection regulations.

8. Restrictions on Use

You agree not to engage in the following activities:

• Reverse Engineering: You shall not attempt to reverse-engineer, decompile, or disassemble any part of PlayShort.
• Data Mining: You shall not use data mining, robots, or similar data collection methods to extract data from PlayShort.
• Commercial Use: You are prohibited from using PlayShort for any commercial purposes, including reselling access to the content, advertisements, or App functionalities.

Any unauthorized use of PlayShort may result in the immediate termination of your account.

9. Account Termination

We reserve the right to suspend or terminate your access to PlayShort at our discretion, including, without limitation, if we believe that you have violated any terms of this Agreement.

You may terminate your account at any time by contacting us at the email address provided below. Upon termination, you will no longer have access to PlayShort, and your data will be deleted in accordance with our Privacy Policy.

10. Links to External Locations and Third Party Websites

The Service may contain links to third-party websites or resources. You acknowledge and agree that we are not responsible or liable for: (i) the availability or accuracy of such websites or resources; or (ii) the content, products, or services on or available from such websites or resources. Links to such websites or resources do not imply any endorsement by PlayShort of such websites or resources or the content, products, or services available from such websites or resources. You acknowledge sole responsibility for and assume all risk arising from your use of any such websites or resources. We may remove any links at any time for any reason or for no reason.

11. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any damages arising out of your use or inability to use PlayShort, including but not limited to indirect, incidental, or consequential damages. This limitation applies whether the damages arise from breach of contract, tort, negligence, or any other legal theory.

We are also not responsible for any third-party content, services, or apps that may be linked or integrated with PlayShort.

12. Indemnification

You agree to indemnify, defend, and hold harmless PLAYIT TECHNOLOGY PTE. LTD. and its affiliates, officers, employees, and agents from any claims, damages, or liabilities arising from your use of PlayShort, your violation of this Agreement, or your infringement of any third-party rights.

13. Infringement of Intellectual Property Rights

PlayShort respects the intellectual property rights of others and desires to offer a Platform that contains no material that violates the intellectual property rights of others. If you believe in good faith that your intellectual property rights have been infringed through use on the Platform, you may notify us by email at: suangela04@gmail.com with “Notice of Infringement” in the subject line, which contains:

• An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright (or other intellectual property) interest;
• A description of the copyrighted work (or other intellectual property interest) that you claim has been infringed;
• A description specifying the location on the Platform of the material that you claim is infringing;
• Your email address and your mailing address and/or telephone number;
• A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright (or other intellectual property) owner, its agent, or the law; and
• A statement by you made under penalty of perjury, that the information in your notice is accurate and that you are the copyright (or other intellectual property) owner or authorized to act on the copyright (or other intellectual property) owner's behalf.

Any notice you submit pursuant to the foregoing must be truthful and must be submitted under penalty of perjury. A false notice may give rise to personal liability. You may therefore want to seek the advice of legal counsel before submitting a notice. Notwithstanding anything to the contrary stated herein, please note that whether or not PlayShort disables access to or removes any materials pursuant to the foregoing.

14. Modifications to the Agreement

We may update or modify this Agreement from time to time to reflect changes in our services, business practices, or legal requirements. When we make changes, we will post the revised Agreement on this page and update the Effective Date at the top of the document.

You are encouraged to review this Agreement periodically to stay informed of any updates. Your continued use of PlayShort after any changes signifies your acceptance of the revised terms.

15. Governing Law and Dispute Resolution

This Agreement will be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law principles. Any disputes arising out of or related to this Agreement shall be resolved through binding arbitration in Singapore, in accordance with the rules of the Singapore International Arbitration Center.
